The Annual Meeting of the Fox Point Homeowners Association will be held on Sunday, December 5, 2021, at 3:00 p.m. at the Fox Point Clubhouse, 6120 Blackstone Blvd., Fredericksburg, VA 22407. Please put this date on your calendars.
At the Annual Meeting, the members will elect two members to serve on the Board of Directors. The two positions elected with the most votes will serve three-year terms.
The qualification requirements and nomination procedures are found in Section 5.3 of the Amended and Restated Articles of Incorporation for Fox Point Homeowners Association. Briefly, in order to be eligible for election to the Board of Directors, a person must be: a) an Owner, b) the spouse of an Owner, c) an Owners tenant, d) an officer, trustee, general partner (or officer or partner of the general partner) or an agent of an Owner, e) the Declarant (or designee of the Declarant), or a Mortgagee in possession (or designee of the Mortgagee in possession). In addition, please note that an Owner or representative of the Owner cannot be elected if such Owner is more than sixty (60) days delinquent in meeting financial obligations to the Association or is found by the Board of Directors, after a hearing, to be in violation of the Association Documents or Rules and Regulations.
Anyone interested in seeking a position on the Board of Directors must complete and return the enclosed Nominating Petition. Please note that Section 5.3(b) of the Articles of Incorporation provides that the nominating petition must be signed by at least five Owners and must also be signed by the nominee or accompanied by a document signed by the nominee indicating a willingness to serve on the Board of Directors. Section 5.3(b) further requires that all nominating petitions must be received at least twenty-five days prior to the date of the Annual Meeting. Thus, completed nomination petitions must be received no later than 4:30 p.m. on November 9, 2021.
